Waukesha, Wisconsin Building Codes

Overview

For residential properties, Waukesha adopted the Wisconsin state building code with amendments, including an amendment that makes the code applicable to new and existing building.  See Waukesha Code, Ch. 16, § 16.01.  The "provisions of Chs. SPS 320 to 325, Wis. Adm. Code, and this chapter shall apply to construction and inspection procedures used for all new and existing one and two family dwellings, manufactured building for dwelling and newly constructed community based residential facilities providing care treatment and services for 3 to 8 adults." Id.

 

For commercial properties, Waukesha adopted the Wisconsin Commercial Building Codes See Waukesha Code, Ch. 16, § 16.01.  "The Wisconsin Commercial Building Code, Wis. Admin. Code SPS chs. 360 to 366, and all amendments adopted thereto, shall apply to all public buildings and places of employment and is hereby adopted by reference as if fully set forth herein." Id.

 

Wisconsin adopts its very own residential building code by regulation.  See Wis. Adm. Code § SPS 320 (accessed 11/11/2013).  In other words, it has not adopted the IRC.  The Wisconsin code is a statewide code that applies to new construction, but allows local jurisdictions to adopt the code, extend it to existing buildings, and add requirements.  

 

Wisconsin adopted the 2009 IBC with amendments. See Wis. Adm. Code § SPS 361.05 (accessed 11/15/2013).  Wisconsin amends its commercial code by Administrative Code.  See Wis. Adm. Code § SPS 361, Administration and Enforcement;  Wis. Adm. Code § SPS 362, Building and Structures.

Existing buildings, meaning buildings that were built in accordance to code at the time of construction, typically merit extra consideration in a current updated code.

The "provisions of Chs. SPS 320 to 325, Wis. Adm. Code, and this chapter shall apply to construction and inspection procedures used for all new and existing one and two family dwellings, manufactured building for dwelling and newly constructed community based residential facilities providing care treatment and services for 3 to 8 adults." See Waukesha Code, Ch. 16, § 16.01 (emphasis added).

Existing Buildings

Wisconsin adopted the2009 IEBC, subject to the modifications specified in chapter SPS 366.  This code would be applicable in Waukesha by virtue of State law and express adoption.  See Waukesha Code, Ch. 16, § 16.01
